The company PRAMI Praha Ltd., with its registered office in Prague 2, Rašínovo nábřeží 384/56, Postal Code: 128 00, Identification Number: 25666398, registered in the Commercial Register maintained by the Municipal Court in Prague, Section B, File C 59466 (hereinafter referred to as the "Operator") is the internet servise provider of tcmsoft.online, which is available from the URL https://www.tcmsoft.online (hereinafter reffered to as "Service") through which can Users of the Service (hereinafter referred to as the "User" or "Users") operate a virtual OFFICE of TCM Practitioner, under the terms and conditions below (the "Terms").
2. Description of the virtual TCM Practitioner OFFICE on tcmsoft.online
2.1. The service enables to registred users keep the entire agenda associated with services of TCM practitioner. Typically, these are tasks such as: making a card to clients, clientś file management, keeping records of visits, Form of tongue and pulse diagnostics, final report, and Form of reccomedation for client. The service has other follow up functions and applications. The service is constantly developing and is a unique software online solution for individuals and companies operating offices, centers or clinics of TCM.
2.2. The Operator allows Users to set up an account free of charge (registration) and then use the services according to the selected license type. The Basic Pack of Services linked to the BASIC license is provided completely for free. Other advanced services and service applications are tied to paid licenses. The user has the right to change the license type for free at any time.
2.3. Service development and technical support for free license (BASIC) is supported by advertisement, which is integrated into the user environment.
2.4. The tcmsoft.online service is possible to link to user's web page and to some Google services.
2.5. The user has the possibility to use the service via internet browser on both a personal computer and a mobile phone connected to the internet.
3. Rights and obligations of the parties
3.1. The Provider undertakes that the data entered by the User when creating a user account will not be provided to third parties. This does not apply in cases where the Operator is legally obliged to provide these data to state authorities.
3.2. The operator does not verify the truthfulness of the data entered by the User, unless it is mentioned or specified in the contractual terms of each service. The operator verifies only the existence of the email address and the fact that the specific email address belongs to a particular user via the confirmation link received on the email.
3.3. The Provider reserves the right to delete user accounts whose owner is suspected from tarnishing provider´s reputation, and/or is in violation with good morals or public order and/or when suspected or found to be used for unauthorized business, spam, breach Copyrights, even without a prior call for redress and without compensation.
3.4. The Provider reserves the right to delete the user account of the User who has not entered the system for more than 9 months. The user acknowledges that after this time, his/her user account may be freed up for registration of another User.
4. Final provision
4.1. For the provision of services by PRAMI Praha, Ltd. will be applied these Terms and Conditions of tcmsoft.online. The provisions of the Individual Terms and Conditions have priority over the provisions of the Terms and Conditions of tcmsoft.online.
4.2. These Terms and Conditions are unconditionally governed by the Business Terms and Conditions for the placement of advertising messages and other advertising elements in Internet applications operated by PRAMI Praha, Ltd., and relevant legislation.
4.3. The Operator reserves the right to unilaterally modify these Terms and Conditions, to the extent that this change will be announced via the Operator's website at least 10 days prior to the effective date of this change.
5. Liability
The provider PRAMI Praha, Ltd. is not liable for any direct or indirect damage incurred due to the connection and use of tcmsoft.online service and the content of the site and is not responsible for any damages incurred due to their partial or complete failure or connection to the internet site. The use of any information and application on the website is solely a matter of discretion and responsibility of the user.
6. Copyright and Trademarks
The service Provider PRAMI Praha, Ltd. is the owner or has all copyrights and other rights to use and protect applications and documents on its website and its content, in particular articles, reports, contributions, contracts, terms, pricelists and other materials (hereinafter referred to as "materials") and trademarks, unless stated otherwise. The information provided on the website is solely for the personal use of users and for the operation of the virtual OFFICE, and their use for other purposes, in particular through their distribution, copying, further processing or modification, is prohibited without the prior consent of the operator.
These Terms and Conditions become effective and valid from 2/2/2017
